California Family Code Section 7501 gives a parent entitled to custody a presumptive right to change the child’s residence. That right isn’t absolute. A court can restrain a move that would prejudice the child’s rights or welfare, but the statute places the initial weight behind the relocating parent. The parent opposing the relocation carries the burden of demonstrating that the move would be detrimental to the child.

Two California Supreme Court decisions define the framework courts apply. In re Marriage of Burgess (1996) established that the relocating parent doesn’t have to prove the move is necessary to keep custody; an existing arrangement changes only if the relocation would be detrimental to the child’s welfare. In re Marriage of LaMusga (2004) expanded what trial courts must examine before granting or denying a contested move, giving the objecting parent a clearer path to show harm.

Factors San Diego Courts Weigh Under LaMusga

The LaMusga framework gives judges a defined set of considerations rather than an open-ended weighing of convenience. Courts look at the distance of the proposed move, the child’s age, the child’s relationship with each parent, the reasons for the relocation, and each parent’s ability to communicate and cooperate. A history of either parent interfering with the other’s relationship with the child is also relevant.

The central question isn’t whether visitation becomes less convenient after the move. Courts ask whether the child can realistically maintain a meaningful relationship with the non-relocating parent once the new residence is established. The dispute turns on potential harm to the child, not on which arrangement is more convenient for either parent, and that distinction defines the evidence that matters and the arguments each side must be prepared to make.

The Procedural Path in San Diego County

A parent seeking to relocate files a Request for Order (RFO) asking the court to modify the existing custody or visitation arrangement to allow the move. That filing opens the case in the San Diego County Superior Court, which hears family law matters at locations in San Diego, El Cajon, Vista, and Chula Vista.

Before a judge will rule on most contested custody matters, the parties must attend Family Court Services (FCS) mediation:

• Mandatory for contested custody: FCS mediation is required before a judicial ruling in nearly all contested custody disputes
• No attorneys inside: FCS sessions are closed to counsel; each parent participates directly with the mediator
• No cost to the parties: FCS mediation is provided free by the Superior Court

Move-away cases require a full best-interest analysis and frequently proceed to trial when the parties can’t reach agreement through mediation or negotiation.
